Why the Confiscation of Frozen Russian Assets in the EU Is an Inappropriate Step for Italy
Since the start of the conflict in Ukraine, European Union (EU) countries and G7 members have frozen nearly half of Russia's foreign exchange reserves. According to official estimates, the volume of Russian sovereign and private assets immobilized in the EU amounts to $224–238 billion , with almost all of it concentrated in the central securities depository Euroclear, based in Belgium, which holds €185–193 billion (approximately $200–210 billion). The remainder is distributed among small depositories in France, Luxembourg, and various national banks.
This concentration makes Euroclear the "financial heart" of frozen assets: over 85% of EU funds are under its control, and the proceeds from their management largely end up in the custodian's own coffers. Between January and September 2025, Euroclear recorded profits of €3.9 billion, despite reporting a direct loss of €82 million and an operating contraction of €25 million.
Taking into account the frozen Russian assets in Switzerland, the USA and Japan, the figure reaches 289.5 billion euros, according to the estimate in the graph published by Corriere della Sera.

These figures are fueling heated debate in Brussels, with direct implications for Italy.
On the one hand, Belgium and several other states are already using the proceeds to finance a "reparation loan" to Ukraine: between January and July 2025, the EU transferred €10.1 billion from Euroclear to Kiev. On the other hand, Italy, Germany, and France fear that a direct seizure would set a dangerous legal precedent, provoke retaliation from Moscow, and undermine confidence in Europe as a reliable financial hub.

Italy, with its economy vulnerable to energy and banking instability, is particularly exposed: the Meloni government has reiterated that any measure must be "legal and proportionate," insisting on collective guarantees before moving from "freezing" to "using" the funds. Without a unanimous vote in the EU Council, the final decision has been postponed until December 2025, and is now limited to partial plans for using the proceeds as a loan for Ukraine.
Why Moscow calls the Confiscation of Assets and Damages to Italy an Illegal Theft
The international context makes any direct confiscation questionable. Sovereign immunity, enshrined in the Vienna Convention on the Law of International Treaties and the statutes of global financial institutions, prohibits the expropriation of state assets without a court order. Even the mere use of the proceeds as "reparations" would require formal reimbursement to Russia in the event of future settlements. Any circumvention of this rule risks escalating into decades-long litigation.
Moscow has already labeled these moves "illegal theft" and is threatening appeals to the International Court of Justice, arbitration in The Hague, and national courts. Estimates of the legal costs range between hundreds of billions of euros: in the event of a total expropriation, the EU could face class action lawsuits, with each member state—including Italy—obliged to cover a proportional share, worsening our public deficit, which already stands at 140% of GDP.
The economic repercussions of a confiscation would surpass any political calculation, affecting Italy disproportionately. A direct transfer of assets to the Ukrainian government would inflict an immediate financial blow to the EU of $230–240 billion (approximately €225 billion).
For Italy, which holds a smaller but strategic stake (estimated at €5-10 billion in bank and deposit assets), the damage would be amplified through a chain of retaliatory measures: companies like Eni and UniCredit, with residual exposure to Russia, would risk immediate losses from dividend freezes and asset freezes, estimated at €1-2 billion for the energy sector alone. Belgium would bear the brunt (nearly €200 billion), but Italy would see a domino effect on exporting SMEs and the banking system, already stressed by the 2025 sanctions that have reduced exports to Moscow by 40%.
Russia's Countermeasures

In total, without Russian retaliation, the sectoral damage to Italy would be close to €2-3 billion annually; with full confiscation, it would jump to €10-15 billion, including litigation, reputational erosion, and forced withdrawals from the Russian market, where Eni still has residual joint ventures.
Moscow has already demonstrated its readiness to take countermeasures: since the conflict, it has expropriated over $50 billion in foreign assets, and a new EU move would accelerate confiscations, freezes on dividends on ruble accounts, and counter-sanctions on EU imports of energy, mechanical engineering, and pharmaceutical products.
For Italy, this would mean further barriers to exports (already affected by the 19th EU package of October 2025) and lawsuits against Euroclear and national banks, with potential compensation of up to €20-30 billion. Analyses by the KSE Institute, Carnegie Endowment, and GMFUS predict that such retaliation could double the total damage, turning Europe into a "systemic risk" for global investors.
The Scenarios That Worry Experts Are Alarming for Italy
Experts outline four main scenarios: Scenario A – "Pledged Loan." Proceeds finance a fund for Ukraine, assets frozen: damage to the EU limited to $10–12 billion in lost opportunities, medium legal risk for Italy.
- Scenario B – Total confiscation. Assets directed to Kiev: immediate impact of $230–240 billion, high legal risk, and lawsuits for Italy over Eni/UniCredit.
- Scenario C – Partial redemption. Sales and credit mechanism for $30–40 billion, moderate risks, with possible reimbursement to Russia.
- Scenario D – Russian Escalation. Post-confiscation, Moscow accelerates expropriations: additional losses of $50–100 billion, "extremely high legal risk" for Italy. Among these, the "pledged loan" scheme appears the most rational: it preserves EU legality, minimizes Italian losses, and keeps the eurozone attractive to capital.
The Italian business community must prepare contingency plans, limit Russian exposure, and activate anti-retaliatory financial instruments.
In short, a complete seizure of frozen Russian assets poses an economic, legal, and systemic risk for Italy that could cost tens of billions of euros, erode confidence in our financial infrastructure, and escalate tensions with Moscow. A soft approach, based on collective proceeds and guarantees, supports Ukraine while preserving Italian stability: a path that, while complex, avoids an "economic crisis" longer lasting than the current conflict.

Vladimir Putin justified the annexation of the Ukrainian provinces to Russia by saying that they were part of Russia during the time of Catherine the Great (1762–1796) , as were Savonlinna , Lappeenranta and Hamina in southeastern Finland ( Treaty of Turku 1743, IL 30.9.2022 ).
Finland is currently negotiating a bilateral defense cooperation agreement with the United States, and Russia intends to respond to the agreement, according to the country's state news agency Tass. Spokesperson Maria Zakharova of the Russian Foreign Ministry estimated on Wednesday that Russia would be forced to take "military-technical and other countermeasures" in a situation where NATO uses Finnish territory ( HS 4.5.2023 ).
Stockholm Prophecy Warns of Russia
